These terms explain how your NuviCard account works, what you can and can't do with it, and what happens if something goes wrong. Please read them before you open an account.
1. Who we are and what these terms cover
These terms are an agreement between you and NuviCard Ltd. ("NuviCard", "we", "us"). They cover your NuviCard account, the app and website, and the services we provide through them. The NuviCard Visa card has its own card terms, which you accept when a card is issued to you. If the card terms and these terms say different things about the card, the card terms apply.
NuviCard is a financial technology company, not a bank. Card services are provided by licensed partners. Your balance is not a bank deposit and is not insured by any government deposit scheme.
2. Eligibility
To open an account you must be at least 18 years old, live in a country where NuviCard is available, and be able to complete identity verification. You may hold one personal account. You may not open an account for someone else or let anyone else use yours.
We can decline an application without giving a reason, and we may have to do so where our partners' licences or local rules require it.
3. Your account
Your account holds a balance in US dollars. You can add money to it, spend it with your card, send it to another NuviCard account, and withdraw it to a bank account or wallet in your own name. We show your available balance, your transactions and any fees in the app as they happen.
You are responsible for keeping the details on your account accurate. Tell us promptly if your name, address, country of residence, phone number or email changes.
4. Identity verification
Every account completes identity verification before a card is issued, and we may ask you to verify again if your details change, if the law requires it, or if we see activity we need to understand. Verification usually means a photo of a government-issued identity document and a short selfie. If you don't complete a verification request within the time we give you, we may restrict or close your account.
We check the information you give us against third-party sources and may share it with our partners for the purpose of compliance screening. Our privacy policy explains how we handle it.
5. Funding, balances and withdrawals
You can fund your account by bank transfer in your local currency, which we convert to dollars at the rate shown before you confirm, or by sending USDT to the personal deposit address in your app, which we credit in dollars. Money sent to your deposit address from a source we can't verify may be held until we have the information we need.
Withdrawals go to a bank account or wallet in your own name. We may ask for proof of ownership before a withdrawal is released.
6. Fees
Our fees are listed on the fees page and in the app, and you see them before you confirm any transaction that carries one. We give at least 30 days' notice before a fee changes, unless the change is to your benefit, in which case it can apply immediately.
7. Acceptable use
You may use your account only for lawful, personal purposes. You may not use it:
- to receive or send money on behalf of anyone else or as a business, unless we have agreed to that in writing;
- for gambling, adult content, weapons, controlled substances, or any activity that is illegal where you live or where the merchant is;
- to evade sanctions, the rules of a payment network, or the limits we set;
- in a way that harms us, our partners or other customers, including by attempting to access systems you aren't authorised to use.
If we believe your account is being used in a way these terms don't allow, we can freeze transactions, hold funds while we investigate, report activity to the authorities where we are required to, and close the account.
8. Security and your responsibilities
Keep your device, your email account and your sign-in codes to yourself. Never share one-time codes with anyone, including people who say they are from NuviCard; we never ask for a code by phone or chat.
Tell us immediately at support@nuvicard.com if you think someone else has access to your account. You can freeze your card yourself in the app at any time. You are responsible for transactions made before you tell us, unless they were caused by our mistake.
9. Closing or suspending an account
You can close your account from the app once your balance is zero and nothing is pending. We can suspend or close it with notice if you break these terms, if the law or a partner requires it, or after 12 months of inactivity. If a closed account holds a balance, we return it to a verified account in your name, less anything you owe us.
10. Our liability
We provide the service with reasonable care and skill. We are not liable for losses caused by events outside our reasonable control, by a merchant, bank or network that isn't ours, or by your breach of these terms. Nothing here limits liability that can't be limited by law.
11. Changes to these terms
We may change these terms. For changes that affect you adversely we give at least 30 days' notice by email and in the app. If you don't agree with a change you can close your account before it takes effect. Continuing to use the account after that date means you accept the new terms.
12. Governing law and disputes
These terms are governed by the laws of the jurisdiction stated in your account agreement. If you have a complaint, write to support@nuvicard.com and we will acknowledge it within two business days and aim to resolve it within 15. If we can't resolve it, your account agreement tells you which dispute-resolution body you can take it to.
